Notwithstanding anything to the contrary, if the purchase of the CD’s constitutes a supply of goods to a consumer, as defined in or provided by any piece of Australian legislation (“Legislation”), then to the full extent permitted by law:

a) nothing in this Disclaimer will be construed as excluding, restricting or modifying any express or implied condition, warranty or right (a “Right”) conferred on you by such Legislation; and

b) The liability of WorkSmart in respect of a breach of a Right under any Legislation, including liability for any consequential loss which you or any other entity or person may sustain or incur, will be limited at WorkSmart’s option to:

(I.)the replacement of the goods or the supply of equivalent materials; or
(II.)the repair of the goods; or
(III.)the payment of the cost of replacing the goods or of acquiring equivalent materials; or
(IV.)the payment of the cost of having the goods repaired.
